1. Introduction
Welcome to Streckenheld, a web and mobile application operated by Streckenheld GmbH ("we," "us," or "our"). By using Streckenheld, you agree to these Terms & Conditions. If you do not agree, please do not use the app.
2. Services Provided
Streckenheld provides a comprehensive logistics and delivery management platform that enables businesses to:
Platform Services:
- Import orders and deliveries from ERP systems
- Combine deliveries into optimized routes
- Assign routes to internal delivery fleet or external providers
- Real-time order status tracking and ETA notifications for construction firms
Mobile Application:
- Driver acceptance of delivery requests
- Digital document exchange with electronic signature capabilities
- Document management and storage
- Real-time communication between drivers and dispatchers
Real-time Notifications:
- Construction firms receive instant updates on order status
- ETA notifications for improved project planning
- Delivery confirmation and proof of delivery
3. Account Registration
To use Streckenheld, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your account credentials.
4. Order Placement & Transactions
- Orders placed through Streckenheld are subject to the terms agreed upon between buyers and sellers.
- We are not responsible for the fulfillment of orders, as transactions are facilitated between users.
- Any financing options are provided by third-party financial institutions, and we are not liable for their terms or decisions.
5. Obligations of Transport Companies (3PLs)
5.1 Submission of Offers
- Each transport request must be answered with either a binding offer or a rejection.
- Requested delivery times and dates are binding. In case of deviations, the offer must reflect the correct times and dates.
5.2 Pricing
- Offers must be submitted as binding total prices ("all-in"), including tolls but excluding VAT.
- Subsequent price changes are excluded.
5.3 Communication and Performance
- Any delays or damages must be reported immediately to the client (e.g., building materials retailer) and to the recipient.
- Short-term cancellations are not permitted; confirmed commitments are binding.
- The driver or the responsible contact person must be reachable during execution of the transport.
5.4 Subcontractors and Legal Requirements
- Passing on transport orders to subcontractors is only permitted with the prior consent of the platform.
- All legal requirements (e.g., driving and rest times, load securing) must be complied with.
- Valid licenses and sufficient transport insurance coverage are mandatory.
5.5 Documentation and Invoicing
- Status updates (e.g., "Picked up", "Delivered") must be provided via the platform.
- Signed delivery documents must be submitted to Streckenheld.
- Invoices must be issued exclusively to Streckenheld.
5.6 Sanctions
Repeated breaches of duty or poor performance may result in exclusion ("blacklisting") from the platform.
6. Obligations of Retailers
6.1 Requests and Offers
- Urgent requests require a response (acceptance or rejection) no later than 12:00 noon on the following working day.
- Subsequent changes to confirmed orders are only permitted after prior agreement, as price deviations may occur.
- Requests that are no longer valid must be cancelled without delay.
6.2 Provision of Goods
- Goods must be made available at the requested and confirmed loading times.
- Small quantities may only be commissioned after prior consultation.
- Immediate deliveries are considered bindingly booked transport orders.
6.3 Cancellations and Payments
- Short-term cancellations are not permitted. If they nevertheless occur, cancellation fees will apply.
- Agreed payment terms must be strictly observed.
6.4 Sanctions
Repeated misconduct or inadequate conditions may result in exclusion ("blacklisting") from the platform.
7. Retention of Title
If an order is financed through a third-party provider, ownership of the goods remains with the supplier or financing entity until full payment has been made. Users acknowledge and agree to this retention of title condition when utilizing the financing module.
8. Data Usage & Privacy
We collect and process personal data as outlined in our Privacy Policy. By using Streckenheld, you consent to such data processing.
9. Limitation of Liability
We are not liable for any damages arising from the use of Streckenheld, including but not limited to transaction disputes, order fulfillment issues, or financial losses.
10. Modifications to Terms
We may update these Terms & Conditions from time to time. Continued use of Streckenheld after changes are made constitutes acceptance of the revised terms.
11. Governing Law & Disputes
These Terms & Conditions are governed by the laws of Germany. Any disputes shall be resolved in the courts of Germany.
